THE RULES OF PERSONAL INFORMATION PROTECTION APPLICABLE TO THE USE OF THE WEBSITE www.ict-cs.org ARE PRESCRIBED HERE. BY ACCESSING THE WEBSITE (provided that you have agreed to the use of "cookies"), REGISTERING FOR NEWSLETTER, APPLYING FOR COURSES UNDER THE CLUSTER ORGANIZATION, SENDING DATA WITHIN THE APPLICATION FOR EMPLOYMENT TO ANY OF THE CLUSTER MEMBERS OR PROVIDING PERSONAL PERSONAL INFORMATION THROUGH THE SITE IN ANY OTHER WAY, YOU AGREE TO HAVE CAREFULLY READ AND FULLY ACCEPTED THE PRIVACY PROTECTION RULES.

 

We in the ICT Cluster of Central Serbia take the personal privacy very seriously. Therefore we have transparent and easy to understand Personal information protection rules, which we strictly comply with.

1. DEFINITIONS

In this Personal information protection rules, the mentioned terms shall have the following meaning: 

Cluster:
Business association ICT Cluster of Central Serbia Kragujevac, with headquarters at 4 Trg Topolivaca street, Kragujevac, Serbia, ID 28117558, represented by legal representative Branimir  Dzenopoljac;   

Site:
The site at the address www.ict-cs.org; 

Site user:
Any natural person accessing and using the Site, including a person applying for the Newsletter, as well as a person being an applicant for a course and/or Employment applicant;

Course applicant:
A natural person applying for any of the courses organized by the Cluster via the Site;

Employment applicant:
A natural person applying for an employment at any of the Cluster members via the Site;

Personal information or information about a person:
Mean any information based on which a natural person is identified or based on which it is possible (independently or based on other information) to identify a natural person;

Cookies
Cookies are small textual files, stored to a computer or another device of the Site user, containing information about your visits to the Site. The Cluster uses this information the next time you visit the Site. The information gathered in this way is of technical nature and is used to improve the user experience at the Site. 

 

2. INFORMATION WE COLLECT

The Cluster collects and processes personal information in the capacity of the Controller, only of the persons who have given their consent for processing, or for a clearly defined purpose, in a lawful manner and in proportion to the purpose of the processing.

Consent of the Site user, where the consent can be revoked at any time without affecting the legality of the data collected up to that moment.

Name, surname, email address, telephone, year of birth, information about availability for the course attendance, background information and other personal information contained in documents sent by the Course applicant via the Site or provided by the Course applicant in  the application

When the Course applicant enters personal information through the Site and agrees to the use of Personal information protection rules.

The consent of the Site user, where the consent can be revoked at any time without affecting the legality of the data collected up to that moment and the collection is necessary to conclude a contract between the Cluster and the Applicant, i.e. for the purpose of preparing the conclusion of the contract (Article 12 Paragraph 2 of the Law on Personal Information Protection).

Name, surname, email address, photograph, as well as any other personal information provided by the Applicant within the employment form

When an Employment applicant enters personal information through the Site and agrees to the use of Personal information protection rules.    

Consent of the Site user, where the consent can be revoked at any time without affecting the legality of the data collected up to that moment.

Other personal information including, but not limited to, email addresses, phone numbers, message content, etc.

When any Site user decides to provide information by sending an email to the Cluster to the email addresses:

Consent of the Site user, where the consent can be revoked at any time without affecting the legality of the data collected up to that moment.

 

3. INFORMATION OF PERSONS UNDER THE AGE OF 18

This Site is intended for the persons over the age of 18. The Cluster does not collect and process personal information of the persons under the age of 18 intentionally. If you have any knowledge that the Cluster collected personal information about persons under the age of 18, contact us at privacy@delete-me.ict-cs.org or to the phone number 066/360-188 immediately.

 

4. WITH WHOM DO WE SHARE THE INFORMATION?

Only the persons employed by the Cluster and members of the Cluster Management Board have access to the information collected by the Cluster, in accordance with the strict internal procedures and the obligation of confidentiality. Personal information is not shared with any third parties, with the exception of the following cases:

  1. Personal information collected by the Cluster from the Course applicant is submitted to the companies being full members of the Cluster, provided that the Applicant has attended and successfully completed the course.
  2. Personal information collected by the Cluster from the Employment applicant is submitted to companies being full members of the Cluster.

The Cluster members to whom we provide personal information are requested to use them exclusively for their own needs for employment of that person, as well as not to use them for any other purpose or contrary to the instructions and directions of the Cluster.  

By filling in the application for a course or application for employment on the Site and providing compliance with the Personal information protection rules, it is considered that you have agreed to submit your data to full members of the Cluster. 

The Cluster shall never provide your information to third parties that are not members of the Cluster, nor use your information for any purpose that is not in accordance with the Personal information protection rules.

 

5. HOW LONG DO WE KEEP THE PERSONAL INFORMATION?

The information on the Site users who applied for the Newsletter are stored until the Site user unsubscribes from the mailing list via email privacy@delete-me.ict-cs.org.

The information provided by the Course applicant is kept in case the person attends the course. After the course is finished, we keep the information for the next two years. 

The information provided by the Employment applicant is kept for two years from the submission of the information
The Cluster reserves the right to keep personal information even after the specified period, if there is a legal obligation for it or if it is necessary for the court or other proceedings.

 

6. SITE USERS RIGHTS

i) Right to access personal information
Every Site user has the right to request access to his/her personal information that the Cluster has at disposal, at any time at privacy@delete-me.ict-cs.org, and the Cluster shall respond to such request no later than 15 days.

ii) Right to correct personal information
Every Sight user has the right to request from the Cluster to correct his/her own personal information, as well to amend, update, delete information, to stop or temporary pause the processing.
The Site user has the right to stop or temporary pause the processing, if he/she has objected the correctness, completeness and accuracy of the information, as well as the right to have that information marked as objected, until its correctness, completeness and accuracy are determined.

iii) Right to deletion of personal information

The Site use has the right to deletion of personal information if:
1) the purpose of processing is not clearly defined;
2) the purpose of the processing has been changed, and the processing conditions for this changed purpose are not met;
3) the purpose of the processing has been completed, that is, information is no longer necessary for accomplishing the purpose;
4) the method of processing is not allowed;
5) the information belongs to the number and type of information whose processing is disproportionate to the purpose;
6) the information is incorrect, and can not be replaced by the correct one by the correcting;
7) the information is processed without consent or authority based on the law, and in other cases when processing cannot be performed in accordance with the provisions of this law.

iv) Right to have a copy
Every user is entitled to request from the Cluster a copy of the personal information that relates to him/her. The Cluster, as a rule, issues a copy of the information in the form in which the information is present.

v) Suspension of the consent 
Every Site User may request to be unsubscribed from the Newsletter in accordance with the Personal information protection rules when personal information of that User is deleted.  
The Employment applicant has the right to revoke his/her consent at any time, in which case the Cluster will promptly delete information about that person.
In all other situations where the collection and processing of data are carried out solely on the basis of consent after the User clearly and unequivocally revokes his/her consent, the information is deleted. 

 

7. LINKS TO OTHER WEBSITES

In some places on this Site, there are links to the sites that do not belong to the Cluster, nor are they under the control of the Cluster. The fact that certain links are placed on the Site does not mean that the Cluster is responsible for them in any way, nor can it affect the way in which the holders of these sites collect personal information. When visiting these sites, make sure you are familiar with their personal information protection rules before disclosing any personal information. 

 

8. LIMITATION OF LIABILITY

The Cluster takes the protection of its Site users' personal information very seriously. We have strict internal procedures that provide protection in accordance with the Law on Personal Information Protection and other relevant regulations. 

However, the Internet is not a medium in which data protection can be absolutely guaranteed, so the cluster can not be held liable for any unauthorized use, destruction or damage to personal information except for failure to fulfil its obligations in accordance with relevant regulations. The cluster cannot be held liable for any inaccuracy of the information entered by other persons, nor for the result of any processing of information whose subject was such information.

 

9. REQUEST FOR EXERCISING OF THE RIGHTS

The request for notice, insight into and a copy of the information shall be submitted to the Cluster in writing to the email address privacy@delete-me.ict-cs.org. The request for exercising of the rights regarding the performed insight shall be submitted to the Cluster in writing in the indicated email address. Such a request contains information on the identity of the applicant (name and surname, the name of one parent, date and place of birth, unique ID number), the address of domicile or place of residence, as well as other information necessary for contact. 

The Cluster shall issue a notice on the submitted application within 15 days from the day of submission, and within 30 days from the date of receipt of the properly sent request for insight into or for the issue of a copy of information, shall allow the applicant to have insight into or to send him/her a copy of the information.

In the event that he/she considers that the Cluster has violated his/her rights as a personal information handler, the applicant who made a request for exercising rights related to processing may file a complaint with the Commissioner for Information of Public Importance and Personal Data Protection in accordance with the Law on Personal Information Protection.  

 

10. USING COOKIES

The Cluster uses cookies to collect information about the use of the Site. The purpose of collecting information through cookies is not to identify the Site user, but to improve the Site's content and user experience. 

If you want to block the use of cookies, you can use the relevant options in your browser's menu. 

There are two types of cookies on the Site, which have different purposes:

  • Technical cookies allow electronic communication and do not have any other purpose, except to ensure the technical functioning of the Site. Equal to them are analytical cookies that the Cluster uses, as they are used to collect a variety of data in an aggregate format for a large number of users.  
  • Third-party cookies, such as, for example, plug-in cookies of social networks (Facebook, Twitter, Youtube). These cookies are not managed by the Cluster, but by third parties. The Cluster does not have access to such cookies. The User should be familiar with the Rules on the use of cookies of third parties on the sites of those third parties, where he/she may agree or refuse to give consent for the use of cookies of the third parties. 

The Cluster does not use cookies for marketing purposes. 

 

11. CHANGES TO PRIVACY PROTECTION RULES

From time to time the Cluster may change or update the Personal information rules. All changes will have effect from the moment of publishing. If you continue to use the Site, it will be considered that you have agreed to the changes.
